  • DUI with a blood alcohol concentration greater than .08. This charge requires the State to prove that a person was driving or in control of a vehicle, the police obtained a blood or breath sample within 2 hours of driving and the results showed an alcohol concentration greater than .08.
  • DUI with a blood alcohol concentration greater than .15. This is called an Extreme DUI and this charge requires the State to prove that a person was driving or in control of a vehicle, the police obtained a blood or breath sample within 2 hours of driving and the results showed an alcohol concentration greater than .15.
  • DUI with a blood alcohol concentration greater than .20. This is called a Super Extreme DUI and this charge requires the State to prove that a person was driving or in control of a vehicle, the police obtained a blood or breath sample within 2 hours of driving and the results showed an alcohol concentration greater than .20.
  • DUI with any illegal Drug or its Metabolite in the system- This charge requires the State to prove that a person was driving or in control of a vehicle and that a person had any illegal drug or non-prescribed medication in the driver's system at the time of driving. This can even include marijuana that had been smoked a month before the driving or a prescribed medication that the State tries to show was not taken exactly as prescribed.

What are the penalties for DUI in Arizona?
